Questions and Answers
The firm provides legal advice and representation in planning and construction law, real estate and urban renewal, condominiums, administrative law, and criminal law.
It is advisable to contact a lawyer in the initial stages, even before negotiations begin - to examine all aspects of the transaction, including conducting a planning, physical and legal inspection of the property, examining the potential for improvement, checking the amount of taxation on the transaction and the applicability of exemptions, and so on.
The improvement levy is a tax imposed when a planning procedure is carried out that increases the value of the land by way of plan approval, easement, or exceptional use. Payment is required when the rights are exercised – for example, when selling or issuing a building permit or commencing use. You can use the help of a lawyer who specializes in planning and construction and an appraiser to reduce the amount of the improvement levy charge and to examine whether you are entitled to an exemption from the improvement levy.
The objection is submitted in writing to the planning institution within 60 days of the publication of the plan. The Planning and Building Law states that an objection must be reasoned, accompanied by an affidavit verified by a lawyer, and sometimes professional opinions must also be attached to the objection. Although it is not mandatory to submit an objection through a planning and building lawyer (except for verifying an affidavit), it is recommended to at least consult with a lawyer who specializes in planning and building before submitting the objection in order to improve the chance of influencing the plan and improving the proposed design.
A permit for extraordinary use allows temporary use for a purpose other than the applicable plan or building permit, while a change of zoning permanently changes the zoning through a new plan. Both actions require approval from planning institutions by taking a planning procedure, and it is recommended to consult a lawyer who specializes in planning and building in this matter.
If an approved plan causes a decrease in the value of a property to which the plan applies or which borders the property, a claim for compensation may be filed within three years from the date the plan came into effect (approximately 15 days from the date of the last publication in the Official Gazette or in a newspaper of a detailed plan or local outline plan). The regulations state that a claim for decrease in value shall be filed together with an appraiser's opinion to prove the damage and the amount of compensation, so it is recommended to hire the services of a lawyer who specializes in planning and construction for the purpose of filing the claim, as well as a real estate appraiser.
In most cases, the authority is given to the Land Registry Inspector. In certain cases (for example, when a maintainer has not been duly appointed) the authority is with the Magistrate's Court. In any case, it is recommended to consult with a lawyer who specializes in condominiums before taking any legal action.
It is recommended that you contact a lawyer who specializes in planning and construction and criminal law immediately upon receiving a notice of intent to enforce the offense, a summons for investigation, or an indictment – in order to prepare properly and protect your rights. In addition, if you know that you have carried out construction on their property without permission from the planning institutions (the local committee or the municipality's licensing authority), it is advisable to contact a lawyer who specializes in planning and construction as soon as possible in order to regulate the construction irregularities in advance and to examine whether the construction is exempt from a building permit.
The Administrative Court intervenes in the decisions of planning institutions only in exceptional cases, for example when there is an excess of authority, extreme unreasonableness, bias, or a fundamental defect in the procedure. It is recommended to consult with a lawyer who specializes in planning and construction and administrative law, in order to examine the decision of the planning institutions and assess the chances of the Administrative Court's intervention.
